Abstract

The aim of this paper is to unravel some possible keys to the understanding of Gómez Dávila’s legal thought, mainly from the study of a short work entitled De Iure, written in 1971 but published later in a Colombian academic journal. More specifically, as we shall see, what is striking is the counterfactual character of his legal thought and the consequences it has for his understanding of the political. Therefore, what this paper attempts to show is that a commentary on Gómez Dávila’s own passage may provide some key to its correct understanding. Specifically, the main hypothesis is that part of his juridical ideas are indebted to his reading of Savigny's work and that the coincidences between the two are not coincidental.
