Abstract

Thomas Pink ha sostenido una interpretación muy restrictiva del derecho a la libertad religiosa en Dignitatis humanae, a saber, que el Estado no es competente para coaccionar a abrazar o mantener la fe o a retornar a ella, pero que la Iglesia sí lo es respecto de los bautizados y que puede pedir o dar licencia a los gobernantes católicos para que ejerzan en ayuda de la Iglesia su jurisdicción. Esta tesis implica que el derecho a la libertad religiosa no es uniforme, dependiendo solo de la dignidad de la persona humana, sino que es variable dependiendo de la jurisdicción (Estado o Iglesia) que ejerza la coacción.
