Resumo

Familiaris consortio n.34 has defined the “Law of Gradualness”, as the progressive fulfillment of the Moral Law, in opposition to the “Gradualness of Law”, which is considered as a rejection of its compelling character. But this is not the only way the Gradualness of Law can be conceived. Saint Thomas presents in his Summa Theologiae an example of gradualness of (civil) law, from which this study propounds the possibility of a kind of gradualness inherent to Moral Law itself which, without depriving it from its binding force, allows its dynamic adaptation to the degree of moral development of its subject.
